1. ACCEPTANCE OF TERMS
These Terms of Service ("Terms") govern your access to and use of the website https://susansfootwear.com ("Site") and the purchase of products offered through the Site. The Site is operated by:

By accessing the Site or placing an order, you ("Customer," "you," or "your") agree to be bound by these Terms, our Privacy Policy, Return & Refund Policy, and Shipping Policy. If you do not agree, do not use the Site and do not place an order.
2. ELIGIBILITY
You must be at least 18 years of age and legally capable of entering into a binding contract under the laws of your jurisdiction to purchase products from Susan's Footwear. By placing an order, you represent that you meet these requirements.
3. PRODUCT INFORMATION AND ACCURACY
Susan's Footwear makes commercially reasonable efforts to display accurate product descriptions, images, materials, sizing, and pricing. However, we do not warrant that product descriptions, colors, or other content on the Site are accurate, complete, reliable, current, or error-free. Product appearance may vary slightly from images due to lighting, screen calibration, and minor batch variations from our supplier.
Footwear sizing and fit can vary between manufacturers and styles. We provide size guides on each product page based on our supplier's measurements, but we cannot guarantee a particular fit. You are responsible for selecting the correct size based on the information provided.
We reserve the right to correct errors, inaccuracies, or omissions, and to change or update information at any time, including after you have placed an order.
4. ORDERS AND ACCEPTANCE
Placement of an order through the Site constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion, including (but not limited to) cases of:
a) Suspected fraud or unauthorized transactions;
b) Inaccurate or incomplete customer information;
c) Product unavailability;
d) Pricing or description errors;
e) Suspected violation of these Terms.
An order is not accepted until we send a shipping confirmation email. We are not obligated to fulfill orders containing pricing errors, even if payment has been processed; in such cases, we will issue a full refund.
5. PRICING AND PAYMENT
All prices are listed in U.S. Dollars (USD). Prices are subject to change without notice.
⚠️ All applicable U.S. import duties and customs charges are prepaid by us through our shipping arrangement (Delivered Duty Paid). You will not be charged any additional customs, duties, tariffs, or carrier handling fees at delivery. The price shown at checkout is the full price you pay.
Applicable U.S. state sales tax (where required by law) will be calculated and displayed at checkout.
We accept the following payment methods:

Payment is processed at the time of order placement.
6. SHIPPING
Products are shipped directly from our supplier's warehouse in the People's Republic of China to customers in the United States. Estimated delivery time is 10 to 21 business days from dispatch.
Full shipping terms, including the Delivered Duty Paid arrangement, are set forth in our Shipping Policy.
7. RETURNS AND REFUNDS
Returns and refunds are governed by our Return & Refund Policy. Returns must be shipped to our supplier's address in the People's Republic of China at the Customer's expense. We do not offer direct exchanges.
8. INTELLECTUAL PROPERTY
All content on the Site — including text, graphics, logos, images, videos, product designs, and the Susan's Footwear brand — is the property of Starc Ecom B.V. or its licensors and is protected under U.S., Dutch, European, and international intellectual property laws.
You may not copy, reproduce, distribute, modify, transmit, display, publish, sell, license, or create derivative works from any content on the Site without our prior written consent.
9. PROHIBITED USES
You may not use the Site to:
a) Violate any applicable law, regulation, or court order;
b) Infringe upon any third party's intellectual property or other rights;
c) Submit false, misleading, or fraudulent information;
d) Engage in any activity that interferes with or disrupts the Site (including viruses, denial-of-service attacks, scraping, or automated access);
e) Resell or commercially exploit any product purchased from Susan's Footwear without our written consent;
f) Misrepresent your identity or impersonate any person or entity.
We reserve the right to terminate access, cancel orders, and pursue any legal remedies for violations of this Section.
10. CALIFORNIA PROPOSITION 65 NOTICE

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SUSAN'S FOOTWEAR AND STARC ECOM B.V. DISCLAIM ALL WARRANTIES, INCLUDING:
a) IMPLIED WARRANTIES OF MERCHANTABILITY;
b) IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE;
c) WARRANTIES OF NON-INFRINGEMENT;
d) WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE PRODUCT WILL FIT YOUR FOOT, WILL BE COMFORTABLE, WILL BE SUITABLE FOR ANY PARTICULAR ACTIVITY OR ENVIRONMENT, OR WILL BE FREE FROM DEFECTS. INDIVIDUAL FIT AND COMFORT VARY BASED ON FOOT SHAPE AND PERSONAL PREFERENCE.
NO ADVICE OR INFORMATION OBTAINED FROM SUSAN'S FOOTWEAR (WHETHER ORAL OR WRITTEN) CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
a) IN NO EVENT SHALL SUSAN'S FOOTWEAR, STARC ECOM B.V., OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING (WITHOUT LIMITATION) DAMAGES FOR LOST PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, PERSONAL INJURY, EMOTIONAL DISTRESS, OR LOSS OF GOODWILL;
b) OUR AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCT SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM;
c) THE LIMITATIONS IN THIS SECTION APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE;
d) NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
Some states do not allow the exclusion or limitation of certain damages, so portions of this Section may not apply to you. In such states, our liability is limited to the maximum extent permitted by law.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Susan's Footwear, Starc Ecom B.V., and their respective officers, directors, employees, agents, affiliates, and suppliers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of:
a) Your breach of these Terms;
b) Your misuse of the product;
c) Your violation of any law or regulation;
d) Your violation of any third party's rights, including intellectual property rights.
14. GOVERNING LAW AND JURISDICTION
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of laws principles.
Any dispute arising out of or relating to these Terms, the Site, or any product shall be brought exclusively before the competent courts of Amsterdam, the Netherlands.
This Section does not affect any mandatory consumer protection rights that may apply in your state of residence and that cannot be waived by contract.
15. THIRD-PARTY LINKS
The Site may contain links to third-party websites or services. We are not responsible for the content, accuracy, privacy practices, or availability of any third-party site. Use of any such site is at your own risk.
16. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. Changes are effective when posted on the Site with an updated "Last updated" date. Your continued use of the Site after such posting constitutes your acceptance of the modified Terms.
17. SEVERABILITY
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to render it enforceable.
18. WAIVER
Our failure to enforce any provision of these Terms shall not be deemed a waiver of that or any other provision.
19. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and Susan's Footwear regarding your use of the Site.
